Terms of Use for CarQR

These Terms of Use ("Terms") govern access to and use of CarQR, including the mobile application, website, public QR alert pages, vehicle alert services, premium features, physical QR products, car scent packages, support channels, and related services.
By using CarQR, you agree to these Terms. If you do not agree, do not use the service.
1. Service Description
CarQR allows vehicle owners to create QR-based vehicle alert pages. A third party may scan a QR code and send a predefined vehicle-related alert to the vehicle owner without seeing the owner's phone number.
CarQR does not guarantee that alerts will be sent, received, read, acted upon, or resolved.
CarQR is not:
- An emergency service
- A replacement for emergency authorities
- A vehicle security system
- A theft prevention system
- A towing or roadside assistance provider
- An insurance service
- A law enforcement tool
- A guaranteed messaging platform
In urgent or dangerous situations, users must contact local emergency services, law enforcement, property management, parking authorities, or other appropriate parties.
2. Eligibility
You must be legally capable of entering into a binding agreement. If you use CarQR on behalf of a company, fleet, organization, rental business, parking operator, or other entity, you represent that you have authority to bind that entity.
3. User Accounts
Users are responsible for:
- Providing accurate account information
- Keeping login credentials secure
- Maintaining access to their email/device
- Enabling notification permissions where required
- All activity under their account
We may suspend or terminate accounts that violate these Terms, create legal risk, abuse the service, or harm users or third parties.
4. Vehicle and QR Use
Users may only create QR codes for vehicles they own, operate, manage, lease, or are otherwise legally authorized to register.
Users must not:
- Register a vehicle without authorization
- Place a QR code on someone else's vehicle without permission
- Use QR codes to impersonate another person or business
- Use QR pages for harassment, stalking, threats, spam, advertising, or fraud
- Attempt to identify or expose vehicle owner contact information
- Circumvent rate limits, CAPTCHA, security checks, or abuse-prevention measures
- Scrape, clone, reverse engineer, or misuse QR pages
We may disable QR codes, block alerts, remove vehicles, suspend accounts, or report abuse where necessary.
5. Third-Party Alert Senders
A person scanning a CarQR code may send only lawful, accurate, and relevant vehicle-related alerts.
Alert senders must not submit:
- Threats
- Harassment
- Hate speech
- Illegal content
- Advertising
- Fraudulent messages
- Personal data of third parties
- False claims
- Malicious links
- Repeated spam alerts
We may rate-limit, block, log, or investigate abusive submissions.
6. Plans and Features
CarQR may offer multiple plans, including:
- Free QR
- Premium Scent
- Ultimate Personal
- Business & Fleet
Features, limits, availability, physical benefits, QR customization, alert history, support levels, and business tools may vary by plan, country, platform, and operational availability.
We may change plan names, features, pricing, eligibility, and availability at any time, subject to applicable law.
Features described as "coming soon", "planned", "beta", "experimental", or "business-only" are not guaranteed and may never be released.
7. Subscriptions and Purchases
CarQR may offer subscriptions, one-time purchases, digital features, physical products, or plan-based entitlements.
Subscriptions may renew automatically unless cancelled before the renewal date through the relevant app store, account settings, or purchase platform.
Users are responsible for managing cancellations. Deleting the app may not cancel a subscription.
Subscription access may be revoked or limited if payment fails, subscription expires, payment is refunded, or abuse is detected.
Where purchases are made through Google Play, Apple App Store, or another third-party platform, that platform's payment, cancellation, refund, and billing rules may apply.
8. Physical Products
Physical products may include QR stickers, QR cards, car scents, premium kits, replacement items, or promotional items.
Physical product availability may depend on:
- Country
- Delivery address
- Stock
- Fulfillment capacity
- Operational availability
- Subscription plan
- Payment status
- Fraud or abuse checks
We may substitute packaging, scent type, material, or design with a comparable alternative where necessary.
Users are responsible for entering accurate shipping information. We are not responsible for delays, losses, failed delivery, customs issues, additional fees, or incorrect addresses caused by user error or third-party delivery issues, except where applicable law requires otherwise.
9. Returns, Refunds, and Cancellations
Refunds are handled according to:
- Applicable consumer law
- App store rules
- Payment platform rules
- Our Refund, Return, Shipping and Subscription Policy
- Product type
- Whether the item is digital, physical, customized, opened, used, shipped, delivered, or already activated
Digital QR/PDF products, activated digital features, personalized QR products, opened car scent products, hygiene-sensitive items, and fulfilled subscription benefits may be non-refundable to the maximum extent permitted by law.
Nothing in these Terms limits mandatory consumer rights that cannot be waived by contract.
10. User Content
Users may provide vehicle names, notes, support messages, alert responses, shipping details, or other content.
Users retain ownership of their content but grant CarQR a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, store, moderate, and use such content as necessary to operate, secure, improve, and support the service.
Users must not upload unlawful, harmful, misleading, infringing, or abusive content.
11. Intellectual Property
CarQR, including its software, design, logo, brand assets, QR page structure, text, workflows, graphics, service logic, and related materials, is owned by or licensed to CarQR.
Users may not copy, resell, reverse engineer, clone, modify, distribute, or commercially exploit CarQR without written permission.
The QR code generated for a user may be used only for the authorized vehicle and within the scope of the relevant plan.
12. Acceptable Use
Users must not:
- Break laws
- Violate third-party rights
- Abuse alerts
- Harass others
- Use bots or scraping tools
- Interfere with service infrastructure
- Bypass security controls
- Send malware
- Upload illegal or harmful content
- Misrepresent identity
- Use CarQR for surveillance or stalking
- Use CarQR to collect personal data unlawfully
Violation may result in suspension, termination, QR deactivation, removal of content, legal action, or reporting to authorities.
13. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted, secure, error-free, or real-time operation.
Service may be affected by:
- Internet outages
- Cloud provider issues
- Mobile OS restrictions
- Notification permission settings
- App store issues
- Device battery restrictions
- User configuration
- Delivery delays
- Maintenance
- Force majeure events
14. Disclaimers
CarQR is provided "as is" and "as available" to the maximum extent permitted by law.
We disclaim warranties of:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted operation
- Guaranteed notification delivery
- Prevention of damage, theft, towing, fines, accidents, or disputes
Users remain responsible for lawful parking, vehicle safety, responding to official notices, complying with local laws, and contacting proper authorities when needed.
15. Limitation of Liability
To the maximum extent permitted by law, CarQR is not liable for:
- Missed, delayed, failed, or unread alerts
- Vehicle damage
- Theft
- Parking fines
- Towing
- Accidents
- Lost shipments caused by delivery providers
- Incorrect user information
- App store/payment provider failures
- Third-party actions
- Loss of data
- Loss of profits
- Indirect, incidental, punitive, or consequential damages
Where liability cannot be excluded, our total liability is limited to the amount paid by the user to CarQR in the three months before the event giving rise to the claim, or the minimum amount permitted by law.
16. Indemnity
You agree to indemnify and hold harmless CarQR, contractors, partners, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:
- Your misuse of the service
- Unauthorized vehicle registration
- Your content
- Violation of these Terms
- Violation of law
- Violation of third-party rights
- Abuse of QR pages or alert systems
17. Termination
We may suspend or terminate access if:
- You breach these Terms
- You misuse the service
- Payment fails
- Legal risk exists
- Fraud or abuse is suspected
- Required by law
- Service is discontinued
Users may stop using CarQR at any time. Certain data may be retained as required for legal, accounting, fraud-prevention, or dispute-resolution purposes.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye, unless mandatory consumer protection laws require otherwise.
Courts and enforcement offices of Türkiye shall have jurisdiction, except where applicable consumer law gives users mandatory rights to bring claims elsewhere.
19. Changes
We may update these Terms. Material changes may be notified through the app, website, email, or other reasonable means.
Continued use after changes means acceptance where permitted by law.
